What will be an ideal response?


Although the Sixth Amendment calls for a "fair and impartial jury," jurors are not always objective and free of bias. Jurors from many different walks of life are randomly selected from a jury pool by the court clerk, so the jurors will vary greatly in their abilities to understand the complexities of law that they will encounter in the courtroom. Additionally, the personalities of the jurors will weigh in on their deliberation and verdict. Given the possibly heinous nature of a criminal court case, the emotions of some jurors could arguably influence how they view the evidence presented in court. With the problems that have been identified by opponents of the jury system, there has been a call to consider the use of professionally paid jurors to hear criminal cases.
