Explain the application of continuous trespass in larceny cases
What will be an ideal response?
If property is wrongly taken at one time but the intent to permanently deprive is not formed until sometime later, there is no concurrence of act and intent required to constitute a crime. To solve this problem the law presumes that the trespassory taking continues until the required criminal intent is formed. At that point, there is concurrence and the crime of larceny is complete.
