Does Lynn have any defenses?
Terry and Lynn were male lovers. Every Friday after work for three years, Terry would come home, drink some beer, start to belittle Lynn, slap, kick and punch Lynn, and then apologize on Saturday morning and promise to stop drinking and never to do it again. After the US Supreme Court outlawed the crime of homosexual sodomy in Lawrence v. Texas in the summer of 2003, Terry and Lynn planned to move to Massachusetts to get legally married. In all of the excitement and anticipation, Terry started to drink on Wednesday, Thursday and Friday nights, always culminating in slapping, kicking and punching Lynn and always a remorseful apology. Just as they were loading the car for Beantown last Friday night, Terry said to Lynn, "What's taking you so long, I'm going to give it to you good," just before Lynn shot him.
What will be an ideal response?
ANSWER: Answers may vary: There are two defenses. 1. battered person syndrome, the fact scenario invites students to recognize the cycle of violence and that battering can occur in any type of domestic partnership; 2. self defense, when Terry says "I'm going to give it to you good" Lynn may fear for his life, but shooting Terry may be excessive force and his self defense may be imperfect.
