Identify and define the four mental states used within the Modern Penal Code? Identify which is the most culpable state of mind. Using the four mental states, provide an explanation of the mentality for the killing of an individual

What will be an ideal response?

Purpose: A person acts purposely when "it is his conscious object to engage in conduct" or cause a particular result. Purpose, according to the Model Penal Code, is the most blameworthy state of mind; Knowledge: A person acts knowingly if he is (a) "aware" that his conduct is criminal or (b) "aware that it is practically certain that his conduct will cause" a harmful result. A person who acts knowingly is less culpable than one who acts with purpose; Recklessness: The Model Penal Code defines recklessness as "A person acts recklessly with respect to a material element of an offense when he consciously disregards a substantial and unjustifiable risk that the material element exists or will result from his conduct. The risk must be of such a nature and degree." Lastly, Negligence: The Model Penal Code defines negligence, as "a person acts negligently with respect to a material element of an offense when he should be aware of a substantial and unjustifiable risk that the material element exists or will result from his conduct. The risk must be of such a nature and degree that the actor's failure to perceive it, considering the nature and purpose of his conduct and the circumstances known to him, involves a gross deviation from the standard of care that a reasonable person would observe in the actor's situation." Considering the killing of an individaul, the mens rea or criminal intent of the defendant, can differ based on the mental state used. The mentality of purpose could be explained as "I have the specific intent to kill my neighbor." The mentality of knowledge could be explained as "I am particularly certain that if I fire multiple gunshots into a crowded room someone will be killed." For the mentality of reckless, the defendant could indicate, "I know it is dangerous to drive under the influence of alcohol and drugs, but I did it anyway and I caused a fatal car accident." For the mentality of negligence, the defendant could argue, "I didn't know the gun was loaded and dangerous, so I let my five-year old son play with it and he fatally shot himself."
