When the police conduct a search with a warrant or when the police are legally present at a particular place and evidence is observed, that evidence may be seized under the provisions of the plain view exception to the search warrant requirement. Plain view extends to car stops as long as the initial car stop is valid (Texas v. Brown). In addition, if in the execution of a search warrant, police find items not listed on the warrant, they may be seized, as long as they are in plain view (Horton v. California).
