Mediation is the process of bringing together disputing parties with the aid of a trained mediator (facilitator) to discuss the problems and find a middle ground or solution to which both parties can agree. Mediation is a nonbinding process, so problems are not always resolved, but this should still be the first form of alternate dispute resolution used.


Mediation is first used when negotiations fail to resolve a particular dispute. An outside neutral player is used as a facilitator and adviser for each party trying to resolve the dispute. The facilitator, who does not impose solutions, will make suggestions in an attempt to move the parties closer to a resolution, guiding all members involved to resolve the dispute among themselves.
