Explain the two versions of the philosophy of retributive justification.

What will be an ideal response?


Retributive justification states that one who has violated the rights of others should be penalized. Punishment restores the moral order breached by the original wrongful act; therefore, society's duty is to punish. Punishment of the deserving honors free will. A second approach is that criminals deserve punishment because they violate social norms. By avoiding questions of morality, this theory fits better with modern approaches to criminal punishment. It also does not impose on public officials the impossible task of deciding subtle degrees of moral guilt.
