Standing mute means refusing to plead; in these instances, the court enters a "not guilty" plea for the defendant, thus preserving the defendant's constitutional right to trial. A no contest plea, also referred to as nolo contendre, means "I do not desire to contest the action." This plea resembles a guilty plea but is different in one important respect: It cannot be used against the defendant in any later civil litigation arising from the acts that gave rise to the initial criminal charge. Also, a plea of nolo contendre means that the defendant does not admit to the crime. A guilty plea, by contrast, requires that the defendants admit and explain (known as allocution) what happened.
