Sexual orientation is not a protected category under Title VII of the Civil Rights Act of 1964. Title VII protects LGBT individuals against employment discrimination on the basis of race, sex, color, religion, and national origin. Therefore, if an LGBT person wants to use Title VII, it will be necessary for that person to bring a case based on sex stereotyping or by alleging discrimination on one of the other bases, such as race or sex.
