It is clear that minority youth are disproportionately represented, regardless of the group that is examined. The reasons for this disparity are many. Possible reasons for why such disparities exist include the following: (1) racial stereotyping and cultural insensitivity (the demeanor and attitude of minority youth can contribute to negative treatment by those in positions in power); (2) lack of alternatives to detention and incarceration; (3) misuse of discretionary authority in implementing laws and policies (e.g., authority figures stacking offenses on a single incident); and (4) lack of culturally and linguistically appropriate services. Bicultural and bilingual staff are needed to help minorities understand the services and court processes.
