Should states have the final say in setting drug policy or making certain drugs criminal while allowing for the personal use of so-called recreational drugs free from the crash of federal drug policy?
What will be an ideal response?
ANSWER: Answers may vary: As discussed in Chapter 1, the concept of federalism allows states the freedom to conduct their own social experiments that comport to the will of their citizens; Oregon allows physician-assisted suicide, Massachusetts allows same-sex marriage, many states have the death penalty and others do not. If states want to allow the recreational use of marijuana, such as in Alaska where it is not a crime to possess four ounces or less of marijuana or other states such as California want to allow marijuana use as medicine, the Constitution should allow the states such freedom from federal government interference.
