Photos of a 2-year-old boywere taken at daycare and posted online with comments that appear to make fun of the child. As a result, two workers at the Heavenly Haven Learning Center were fired. One of the photos shows the child sitting in a highchair,
looking sad. The picture was accompanied with the caption, "I'm sick of this [expletive]!!!" Another photo shows a second child juxtaposed with the image from a character from "Cars," with the poster apparently comparing their teeth and smiles. What legal theory supports A Heavenly Haven's decision to terminate the two employees? Explain and define. Do theterminated employees have any legal defense justifying their reinstatement? If so what and if not, explain.
The doctrine of employment at will supports the discharge. Employees may hire and fire at will absent a statutory prohibition. There is nothing to suggest illegal discrimination motivated the firings. There are public policy exceptions to at-will employment. Whistle-blowing that serves the public interest in one example. This type of behavior by employees, however, could jeopardize the employer's ability to attract clients, and seems to suggest a breach in the agents' fiduciary duties of loyalty and care.
