Both the privilege for confidential marital communications and the husband-wife privilege not to testify against each other are based on respect for marriage and an attempt to prevent testifying in court driving a wedge between the partners. The time period that the privileges focus on is different. The confidential communications privilege only covers communications made during marriage. The privilege not to testify only applies while the parties are married but by preventing a person from taking the stand it effectively blocks introduction of statements made before and during the marriage. The list of exceptions is similar. In both cases the privilege does not cover crimes of one spouse against the other, crimes against the children of either spouse, failure to support the spouse or a child, and bigamy. All of these situations indicate that the marriage has ceased to fulfill the role that the privilege was designed to protect.
