A strong answer will include the following: assent, permission from one parent or guardian is often times sufficient, in some cases consent from both parents is required unless one parent has died, is incompetent, not available, or there is not second parent who has custody of the child. Subpart D protects children. Assent requirements can be waived as per 45 CFR 46.408(a), by IRB committees if the child’s age, maturity and psychological state makes obtaining assent impossible, and the research will directly benefit the child.
