Give examples of both constitutional and unconstitutional knock-and-talk searches.

What will be an ideal response?

Most courts approve of knock-and-talk searches on the grounds that the police, by knocking on an individual’s door, are doing no more than any citizen might do and are not violating a resident’s expectation of privacy. The police may conduct a “knock and talk” at any entrance that is open to visitors rather than only at the front door. See Carroll v. Carman, ___U.S.__ (2014). These types of searches have been held unconstitutional when the police pressure a resident by drawing their weapons or threatening or coercing the resident or when the police enter into an area of the home with an expectation of privacy without a warrant (United States v. Thomas, 430 F.d 274 [6th Cir. 2005]).
