Other behind-the-scenes actors are managers. A constant complaint is that the courts are mismanaged. Alas, the definition of management in a court setting is elusive. Part of the difficulty is that in many jurisdictions, three distinct sets of court managers—clerks of court, chief judges, and court administrators—are often in competition. Just as important, it is difficult to define what the managers should be doing. A fundamental conflict exists between management (standardized work processes and standard outputs) and the profession of law (individual attention to cases that are fundamentally different). Thus, at the heart of the problem of managing the courthouse is the tension between the rationality of bureaucracy and the anti-bureaucratic philosophies of judges (DuPont-Morales, Hooper, & Schmidt, 2000; Lens, 2015; Saari, 1982).
