The Supreme Court ruled that a person has the right to have an attorney present when participating in an identification procedure that is held after the arraignment or indictment. The attorney's role is that of an observer. He/she does not have the right to stop the procedure or to tell the police how to conduct it. If a person is told to participate in a lineup or showup before the arraignment or indictment, there is no Sixth Amendment right to have an attorney present at the proceeding. Photographic lineups are normally not covered by the Sixth Amendment because the defendant is not present when they are conducted.
