Name three of the five circumstances in which the defense of duress may be successfully used by an actor.

What will be an ideal response?

Answers can include any of the following:

Another person must threaten to seriously injure or kill the actor or a third person
(especially a close relative) unless the actor commits the crime.
The actor must reasonably believe that the threat is real.
The threat must be immediate or imminent at the time the actor commits the crime.
There must be no reasonable means of escape from or avoidance of the threat other
than for the actor to commit the crime.
The actor must not be at fault in exposing himself or herself to the threat. Some
jurisdictions that do not recognize duress as a complete defense for intentional killing will allow it to reduce the crime from murder to manslaughter.
