Explain the “deadly weapon doctrine” and discuss what makes something a deadly weapon.

What will be an ideal response?

Guns, knives, and other instruments that are designed to be weapons when used against a victim are obviously deadly weapons. Depending on the circumstances, knives, piano wire, and rapidly swung heavy purses can be deadly weapons. A jury evaluating these situations would look to the intent of the defendant. An angry woman swinging her purse knowing that it held a large heavy vase with intent to do bodily harm was wielding a deadly weapon. Similarly, belts or scarves used to strangle or even restrain persons can be deadly weapons, if their use results in serious bodily harm.
