Answer: Both types of arrest policies are different. Mandatory arrest requires a police officer to arrest a person without a warrant based on probable cause that an offense occurred and that the accused person committed the crime. Progress laws give authority for an arrest without a warrant as the preferred, but not required, action in cases of domestic partners. If an officer fails to make an arrest, they may be required to file a written incident report justifying why they did not arrest.
