Answer: In order to obtain a civil protection order the victim must meet several criteria. First, the victim and the abuser must be related family or household members as defined by specific state law. The abusive or threatening behavior must also be prohibited by criminal statute and be perpetrated against the victim who is filing for protection. The victim must make a written application for the order protection called the petition. This petition must be filed before a state or federal court with jurisdiction over the subject matter where the abuse occurred or where the victim would be at risk.
