Answers should identify how the war on terror created a legal “netherworld” because there was very little guidance from domestic and international law in regard to executing a war against a nonstate entity. The Bush administration, being without adequate legal guidance, began to test the limits of domestic and international law. Subsequently, the war on terror required the Supreme Court to address the authority of the president, particularly in regard to the rights of detainees and their treatment during detention, as well as their legal rights during their trials. Answers should also address SCOTUS rulings in cases such as Rasul v. Bush and Hamdi v. Bush that detainees were allowed to appeal the legality of their detention and were entitled to their right of habeas corpus. Answers should also address the cases of Hamdan v. Rumsfeld and Boumediene v. Bush, which also addressed the rights of detainees and whether they could be subject to military commissions. Answers may also address how President Obama has challenged the judicial system with actions that are legally unclear, such as the use of unmanned aerial vehicles, targeted killings, and the continued military tribunals at Guantanamo Bay.
