The Occupational Safety and Health Act created the Occupational Safety and Health Administration (OSHA) to ensure-to the extent feasible-safe and healthful working conditions for U.S. employees. The law covers businesses that are engaged in interstate commerce and have one or more employees, except those covered by the Atomic Energy Act or the Federal Mine Safety Act.
OSHA encourages increased examination and questioning of management's staffing decisions and equipment selection. If workers believe their employer's violation of job safety or health standards threatens them with physical harm, they may request an OSHA inspection without being discharged or discriminated against for doing so. They can participate in any resulting hearings and can protest if they think the penalty is too light. And they can request that the Department of Health and Human Services check to see if there is any potentially toxic substance in the workplace and have safe exposure levels set for that substance.
Even though many accidents result from employees' own lack of safety consciousness, employees usually do not receive citations. Instead, OSHA holds employers responsible for making employees wear safety equipment.
Employers are subject to fines for unsafe practices regardless of whether any accidents occur.
