The two methods are to be found not guilty by reason of insanity (NGRI) or to be found incompetent to stand trial. The first, NGRI, involves a defendant who does not deny committing the crime but who lacks the capacity to understand the nature of the crime or that it was wrong. The second is based on the common law criteria that defendants must be able to understand the charges against them and be able cooperate with their counsel in preparing their own defense.
A defendant who is found to be incompetent to stand trial usually will be committed to a mental institution until declared competent.
