The first requirement for admitting evidence is that it is relevant. The same standard applies when someone attempts to admit privileged statements. In addition to finding an exception to the privilege, the attorney must be able to establish that the statement is relevant to the case at trial.
All privileged communications are also hearsay. To be admissible at trial, a statement must fall under an Exception to the Hearsay Rule and an Exception to the Privilege.
If the privileged communication is in writing, all rules applicable to writings must be satisfied. The document containing the privileged information must be authenticated and primary evidence of its contents must be presented. If a satisfactory explanation has been given for the lack of primary evidence, the court will accept secondary evidence.
