Court action on behalf of neglected, abused or dependent children may be noncriminal. The court seeks to identify whether the child is in danger and, if so, what is needed for the child's protection. The parents may lose custody of the child, be required to pay child support or be ordered to make adjustments in care, custody and control. A second option is criminal prosecution of the parents on charges that they have committed a harmful act against the child or have failed to discharge their responsibility, thus placing the child in active danger.
This action does not involve the child's status. The scope of the court's position
in these referrals is based on the juvenile court's responsibility for the child's welfare
under the philosophy of in loco parentis, Latin for "in the place of the parent.".
