Section 5 is considered to be broader than the other antitrust laws because it covers conduct that (1) violates any provision of the Sherman Act or the Clayton Act, (2) violates the "spirit" of those acts, (3) fills the gaps of those acts, and (4) offends public policy; is immoral, oppressive, unscrupulous, or unethical; or causes substantial injury to competitors or consumers.
The Federal Trade Commission (FTC) is exclusively empowered to enforce the Federal Trade Commission Act. The FTC can issue interpretive rules, general statements of policy, trade regulation rules, and guidelines that define unfair or deceptive practices; the FTC can conduct investigations of suspected antitrust violations. The FTC can also issue cease-and-desist orders against violators; these orders are appealable to federal court.
