Hate crime legislation is legislation that is directed specifically at crimes that result from bias. According to Herek, Gillis, and Cogan (1999, 946) "hate crimes represent a special case because of their more serious impact on both the crime victim and the larger group to which she or he belongs." In a hate crime, the wider ramification extends to the group that the person represents or to the identity (i.e., attributes) that caused the person to be attacked in the first place. Although the legislation may be too narrow, it may be done so purposefully to rely on what is currently protected under the law. The reason for this reliance on civil rights and protected classes may be to give more flexibility and wider inclusion of other groups at the state level (see page 12 in text).
