A pen register is a device that records electronic impulses to identify the numbers dialed for outgoing calls. To obtain approval for a pen-register order, the law enforcement agency only needs to certify that “the information likely to be obtained is relevant to an ongoing criminal investigation.” A prosecutor does not have to justify the request, and judges are required to approve every request.
