In researching the law in a case, the paralegal finds a case which supports the other side. What are the ethical obligations?
What will be an ideal response?
Attorneys and paralegals must act with honesty and integrity both in court proceedings and in personal conduct that reflects adversely on one’s fitness for the practice of law. As an advocate, a lawyer may advance good faith arguments based on law and fact that seek an extension or reversal of current law. Claims and contentions must have some merit and not be frivolous. A lawyer shall not knowingly make a false statement of fact or law to a court, and is obligated to disclose known authority to a court, even if opposing counsel has failed to cite such authority, although such authority may not be beneficial to a client. Arguments as to why the law does not apply or against its application can be made.
