The U.S. Supreme Court in Gideon v. Wainwright held that the Sixth Amendment to the Constitution guarantees individuals charged with a felony access to a lawyer in criminal prosecutions. The Court explained that it was an “obvious truth” that the right to an attorney is central to the guarantee to a fair trial. Absent a lawyer, a defendant could not adequately present evidence in his or her defense, cross-examine prosecution witnesses, or navigate through the technicalities of the law of evidence and court procedures (Gideon v. Wainwright, 372 U.S. 335 [1963]). The Court later clarified that the right to an attorney at trial applied to any case in which a defendant might be incarcerated.
