Did the event mean what he said it meant? These risks can be tested by cross-examination, where the witness is available to explain his perceptions or demonstrate the clarity of his memory. An example would be if the witness testifies: "Fred told me he saw the defendant throw something through the window of the building, and then the building caught fire." It is possible, but very unlikely, that the witness may have questioned Fred to determine the accuracy of this statement. If not, the defendant will not be able to do so because Fred is not at the trial.
