This testimony generally presents four risks relative to its truthfulness: the accuracy of the witness' perception, the memory of the witness, the meaning of the testimony, and the sincerity of the witness. The truth of this statement carries the risks identified above: Is the witness sincere? Is his memory of the event clear? Were his perceptions of the event accurate? Did the event mean what he said it meant? These risks can be tested by cross-examination, where the witness is available to explain his perceptions or demonstrate the clarity of his memory. An example would be if the witness testifies: "Fred told me he saw the defendant throw something through the window of the building, and then the building caught fire." It is possible, but very unlikely, that the witness may have questioned Fred to determine the accuracy of this statement. If not, the defendant will not be able to do so because Fred is not at the trial.
