Examples may include that it is often in the best interest of the defendant to delay trial, as it may weaken the prosecutor’s case. The longer it takes to go to trial, the more likely the victim and witnesses will forget details and emotions will be less charged. Prosecutors may also gain an advantage in plea bargaining. Delays may be problematic for several reasons--victims and families who have to wait for justice, wasted resources in the criminal justice system, those without means are stuck in jail without bail, and those on bail may commit additional crimes.
