Explain the basic procedure to be followed by supervisors when performing an internal affairs investigation.
What will be an ideal response?
All investigations and the management of complaint investigations are controlled and coordinated by an internal affairs unit (IAU). If the complaint or charge is significant, investigators from internal affairs will handle the complaint totally. If it is an informal complaint, it will be handled by a supervisor. In some cases, internal affairs will forward minor formal complaints to the unit commander for investigation. The commander will then assign the case to a supervisor who conducts the investigation. Once the investigation is completed, it is reviewed by the unit commander and internal affairs. Finally, in some cases, unit supervisors will be assigned to assist internal affairs in the investigation. After being assigned an investigation, supervisors review all the available evidence: documents, statements, reports, and photographs.
Next, all the parties involved are interviewed. After interviewing witnesses, supervisors should have a solid understanding of the case and prepare a list of questions to ask the complainant.
With regard to subject officer interviews, police leaders must ensure that their supervisors know their applicable state statutes or confer with their legal advisors regarding peace officers' rights while under investigation. An investigative report must then be written that contains all the relevant facts of the case. Once an investigation is completed, a determination as to the culpability of the accused employee is made.
