Students must sufficiently summarize the case by providing facts about the defendant’s acts of writing the letter, getting the “letter” stamped, and sending out the letter, as well as the nature of the letter. The main issue is whether the defendant’s acts amounted to solicitation under New Mexico law when the wife never actually received the letters. The Model Penal Code has a requirement that a solicitation need not be fully communicated to constitute solicitation. As a result, the defendant would be found guilty because solicitation is complete once the soliciting statement was made. Furthermore, the fact that another inmate switched out the letter for a blank piece of paper might be considered an extraneous factor.
