Student opinion will vary but a general deterrence argument is difficult to support given that the offender may well be unmindful that he is committing a kidnapping. Without being aware that his conduct supplementary to the primary offense is just as serious, or more so, than his intended offense, it is difficult to see how the possibility of additional punishment would act as a deterrent. Certainly, punishment may be appropriate for the offender's conduct, but the stated purposes of the Penal Code do not list punishment of offenders as an objective.
