Research shows that juveniles are not appointed legal counsel in all cases, despite the Supreme Court, in In re Gault, stating, "We conclude that the Due Process Clause of the Fourteenth Amendment requires that in respect of proceedings to determine delinquency which may result in commitment to an institution in which the juvenile's freedom is curtailed, the child and his parents must be notified of the child's right to be represented by counsel retained by them, or if they are unable to afford counsel, that counsel will be appointed to represent the child.". Admittedly, juvenile courts have broad discretion, and such terms as institutionalization are not as easily interpreted as are terms in the adult system. In re Gault applied Sixth Amendment rights to juveniles, with some areas of application remaining to be addressed by the Court.
