First-degree murder is homicide committed with vicious and premeditated intent. Nonnegligent manslaughter is the killing of a human being without premeditation but with the intent to kill in the heat of the moment. It’s similar to second-degree murder. Negligent manslaughter is the unlawful killing of another through reckless or negligent behavior, without intention to kill. The difference between them is that malice aforethought must be present for murder and absent for nonnegligent manslaughter.
