Explain the concept of proportionality

What will be an ideal response?


Proportionality has been interpreted by courts to mean that a sentence imposing punishment must be proportionate to the offense. If a sentence is out of proportion to the crime, the courts may hold that it violates the prohibition against cruel and unusual punishment and is thus void. The issue of proportionality may also be raised when examining the length of the sentence imposed and comparing it to the type of crime committed.
