Rape shield laws are laws held in most states governing what the defense attorney in rape cases can introduce as evidence in regards to the victim's past sexual conduct. Defense attorneys are limited to evidence of convictions of prostitution or had previous sexual relations with the defendant. If the defense attorney is seeking to bring up a victim's past sexual history, a hearing must be conducted before the judge alone for her to determine whether the defense is justified due to its relevance. Victim defenders argue the rape shield law encourages reporting and increases the prosecution rate. Juries should not be distracted by a victim's past sexual history when they should be looking at the defendant's behavior. Those who blame the victim contend such limitations impact the defendant's right to confront his accuser.
