Sex Offender Registration: A relatively new trend is to require convicted sex offenders to register his/her name and address upon release from prison. This allows the community in which the convict is now living to be alert to the possibility that a person in their town may pose a risk to their children. However, civil libertarians claim that it serves as a punishment continuing past time already served by the convicted offender. The Supreme Court has ruled that such laws, sometimes called “Megan’s Laws,” are not double jeopardy, but that the state must show some potential for the offender to reoffend.
Chemical Castration: In several European countries and in California and Georgia, it is required that a convicted sex offender must agree to take medication that will reduce the amount of testosterone and lower the male libido as a condition of parole. Although it has not be deemed impermissible at the time of this text’s publication, it is rather controversial and is likely to face challenges in the future based on protections against cruel and unusual punishment.
