Modern burglary is much more expansive then common law burglary. A criminal can "burglarize" all kinds of structures, even vehicles, at any time of the day. The breaking and entering elements have been eliminated or modified, and the crimes the burglar intended to commit do not always have to be a felony. A less serious crime related to burglary is criminal trespass. Trespass used to be limited to unauthorized invasions of physical property, but it has been expanded to include not only entering land but also buildings, computers, and other electronic information systems. The actus reus of criminal trespass is the unauthorized entering of or remaining on the premises of another. The mens rea varies among the states, including (1) knowingly entering or remaining without authority, invitation, license, privilege, or legality (most states); (2) the specific intent to enter or remain without authority for some unlawful purpose (a few states): or (3) strict liability for entering or remaining.
