In 1958, the Supreme Court made a ruling in the case Trop v. Dulles that was seemingly unrelated to concerns with the death penalty. In Trop, the Court developed a phrase that would be cited in future cases because it fit so well with many compelling arguments in favor of reform within the correctional system. According to the Court, there existed “evolving standards of decency that marked the progress of a maturing society.” This statement has been used by opponents of the death penalty to justify why the death penalty should be eliminated from the range of sentencing options.
