Part B of PL 99-457 requires that all preschoolers, ages 3–5, with special needs have access to free public education. All states were mandated to offer services to this population by 1991–1992. It was fully achieved in the 1992–1993 school year. This is significant to early childhood special education because prior to the enactment of this law, 31 states and territories did not require special education services to preschoolers with special needs, and studies found that less than 80% of exceptional children aged 3–5 were being served.
