In Graham v. Florida (2010), the Court banned the use of life without parole for juveniles not convicted of homicide. The Court held that the Eighth Amendment’s ban on cruel and unusual punishment forbids such sentences. At that time, Graham was considered a watershed case that affected sentencing practices for many states around the nation. Two years later, the case of Miller v. Alabama (2012) led to the Supreme Court ruling that mandatory sentences of life without the possibility of parole are unconstitutional for juvenile offenders. This ruling extended the earlier ruling in Graham v. Florida. Essentially, Miller eliminated murder from being a justification for a life sentence without the possibility of parole for juveniles. Nevertheless, the cases have demonstrated how far-reaching a Supreme Court decision can be within our justice system.
