The exclusionary rule is judge-made case law to prevent police misconduct. It prohibits the use of evidence obtained in violation of a person's constitutional rights. Essentially, it expresses the Court's unwillingness to support an unlawful act by an overzealous officer who breaks the law in a misguided effort to enforce the law. Originally applying only to the federal government in Weeks v. United States, it was applied to the states in the 1961 case of Mapp v. Ohio.
