Initially, legal doctrine regarding unions and union activity was established by customs, traditions of acceptable behavior, and decisions by judges (i.e., common law). This legal doctrine included the concept that unions acted as conspiracies against the government, property rights took precedence over labor rights, and the nature of the employment relationship was "at will." As statutory law developed, it supplemented and, in some cases, supplanted common law. Initially laws were developed to govern business activities and the nature of competition. In the 1930's, labor law began to develop to govern the employer-employee relationship. Today, the emphasis is on employment law, or laws written to establish minimum standards for the individual employment relationship such as those prohibiting discrimination or giving rights to family medical leave.
Second half of this question is a matter of opinion but students could point to wage and hours laws, employment law, OSHA, and other laws as substituting for unionization. They might, on the other hand, point to the decline in unionization and the number of unfair labor charges as evidence to support the opposing position.
