What is the purpose of rape shield laws?
What will be an ideal response?
Rape shield laws were passed partly in response to low reporting rates for rapes and other sexual assaults. Many victims feared having to testify in open court about a traumatic event. In addition, many defense lawyers used cross-examination to humiliate victims by asking about their sexual history. In response, many state legislatures passed rape shield laws to limit the kinds of questions that can be asked. Now victims may be asked questions directly linked or relevant to the assault in question, such as questions about prior consensual sex acts with the defendant (relevant because it may go to the question of consent.) No longer must victims endure questions about their entire sexual history or about the clothing they wore.
