The Supreme Court listed three criteria to be considered:
1 . the reprehensibility of the defendant's conduct.
2 . the ratio between the harm suffered and the award.
3 . the difference between the punitive award and any civil penalties in similar cases.
Although the Court has not given a definitive ratio between compensatory and punitive damages, the Court has said a trial court generally should not permit a punitive award more than nine times higher than compensatory damages and the trial court may not use the defendant's wealth as an excuse to award an unreasonably high amount.
