Generally, we use the idea of “coverture” to determine a marital interest. The portion of a pension earned before or after marriage is separate property, and the portion contributed during marriage is generally marital property. A plan evaluator will sort out the amount attributable to marital property, and distinguish separate property. A QDRO will order a plan administrator to make an appropriate distribution.
